Acceptance of Terms
Welcome to Subseven, a mobile application designed to help individuals with Type 1 Diabetes log events and gain insights into their blood glucose patterns. By downloading or using the Subseven app (the “App”), you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree with these Terms or the Privacy Policy, you must not use the App. These Terms constitute a legal agreement between you (the user) and Subseven (referred to as “Subseven,” “we,” “us,” or “our”). We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify users through the App or via email. Your continued use of the App after any changes indicates your acceptance of the new Terms.
Description of the Service
Subseven provides an AI-driven personal diabetes management service. The App allows users (primarily individuals with Type 1 Diabetes) to log various events that can affect blood glucose levels – such as meals, insulin doses, exercise workouts, stress, sleep quality, menstrual periods, travel/vacation, and other factors – and view insights and trends derived from this data. The App can also connect with Apple HealthKit to import continuous glucose monitor (CGM) data (for example, blood glucose readings from a Dexcom device) for analysis alongside logged events. Through charts, analytics, and pattern recognition, Subseven aims to help users and their clinicians make more informed decisions in managing Type 1 Diabetes. However, nothing in the App’s content or services is intended to constitute medical advice, diagnosis, or treatment . Always consult your physician or healthcare provider for professional medical advice regarding your diabetes management. The App’s insights are for informational and educational purposes only and are not a substitute for professional medical advice or emergency services .
User Eligibility and Accounts
Intended Users: The App is intended for use by individuals living with diabetes (initially focused on Type 1 Diabetes; support for Type 2 Diabetes may be added later). You must create a personal user account to access the App’s features. By creating an account, you represent that you are either (a) at least 18 years old, or (b) if you are between 13 and 17 years old, that you have the consent and supervision of a parent or legal guardian to use the App. The App is not intended for children under 13 years of age, and no one under 13 should use or provide personal information to the App . We do not knowingly permit children under 13 to use Subseven. If we become aware that a child under 13 has an account, we will terminate the account and delete any associated information in accordance with our Privacy Policy .
Account Registration: To use Subseven, you must provide certain basic information for account setup, including your name and a valid email address. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. Do not share your password or account access with others. If you believe your account has been compromised or accessed without authorization, you must notify us immediately so we can take appropriate action.
Geographic Availability: Subseven is currently offered for use primarily in the United States. However, anyone with access to Apple’s App Store and a compatible iPhone may download and use the App, subject to local laws and Apple’s policies. If you reside outside the U.S. and choose to use Subseven, you are responsible for ensuring that your use complies with any local laws and regulations. The App is in English and may not be localized for other languages or regions.
Subscription, Fees, and Payments
Paid Subscription: Subseven is offered on a subscription basis. By creating an account and subscribing, you agree to pay the subscription fee and any applicable taxes. The current subscription rate is USD $19.99 per month. All payments for the subscription are handled via Apple’s in-app purchase system on the App Store. This means you will be charged through your Apple ID account, and Apple’s payment terms and conditions apply to the transaction. We do not directly process your credit card information or billing details – those are handled securely by Apple.
Auto-Renewal: The Subseven subscription will auto-renew each month at the then-current subscription price, unless you cancel the subscription at least 24 hours before the end of the current billing period. Your Apple App Store account will be charged for renewal within 24 hours prior to the end of the current period. By subscribing, you authorize Apple to charge the monthly subscription fee on a recurring basis.
Cancellation: You may cancel your Subseven subscription at any time. Cancellation must be done through your Apple App Store account settings. (For example, you can go to your iPhone’s Settings -> [Your Name] -> Subscriptions and then select Subseven to cancel.) If you cancel, your subscription will remain active until the end of the current paid period, and you will not be charged for the next period. Refunds for subscriptions are governed by Apple’s App Store refund policies. As a general rule, once a monthly subscription period has started, it will remain active for that period and is non-refundable (partial refunds for unused time are usually not provided, per standard App Store policies). If you believe you have special circumstances warranting a refund, you will need to request it from Apple directly, as we are bound by Apple’s policies regarding in-app payments.
Changes in Fees: Subseven may decide to change the subscription price in the future. If we do so, we will notify you in advance (for example, via an in-app notification or email) and provide instructions on how to accept the new rate. Any price change will only take effect at the start of a new billing cycle. If you do not agree to a price change, you will need to cancel your subscription before the new rate is applied. Continuing to use the App after a price change takes effect constitutes acceptance of the new price.
Permitted Use of the App
Personal Use Only: Subseven is licensed to you for personal, non-commercial use. You may use the App and its content solely for tracking your own health metrics and for your personal wellness management. You agree not to use the App for any unlawful or prohibited purpose. Specifically, you agree that you will not:
Violate Laws: Use the App in any way that violates any applicable federal, state, or international law or regulation . This includes, but is not limited to, attempting to use the App to engage in fraud or misuse of medical information.
Unauthorized Access: Attempt to gain unauthorized access to the App, other users’ accounts, or Subseven’s computer systems or networks. You will not attempt to disable, hack, or interfere with the proper working of the App . Any form of attempting to breach the App’s security, such as introducing malware or circumventing encryption, is strictly prohibited.
No Reverse Engineering: Copy, modify, distribute, create derivative works of, or reverse engineer any part of the App. You may not decompile or attempt to extract the source code of the App, except to the extent that such activity is expressly permitted by law notwithstanding this restriction.
No Commercial Exploitation: Resell, rent, lease, or commercially exploit the App or any data or output from the App. The insights and analytics provided are for the user’s personal informational use only and not for redistribution.
No Harmful Input: You agree not to input any false or misleading data into the App. Because the App’s analytics rely on user-entered events (such as meals, exercise, etc.), entering deliberately incorrect data could lead to misleading insights. You also agree not to use the App to store or transmit any content that is illegal, harmful, or that you do not have the right to share.
No Content Upload/Sharing: The App does not offer features for public content sharing or social networking. You cannot upload media, text posts, or share content with other users through Subseven. Accordingly, you agree not to attempt to circumvent this by any means (for instance, by trying to manipulate input fields to inject sharable content). The data you enter is for your use and analysis only.
Violation of any of the above can result in immediate termination of your account and access to the App, at our discretion. We reserve the right to investigate any breach of these rules and to cooperate with law enforcement in prosecuting users who violate the law.
Health and Medical Disclaimers
Not Medical Advice: While Subseven provides tools and analytics to help you manage your diabetes, it is not providing medical advice. The content, analyses, and suggestions generated by the App should not be considered a substitute for professional medical advice, diagnosis, or treatment . Subseven does not practice medicine or any licensed profession; the App’s outputs are based on algorithms and user-provided data and are for informational purposes to assist you and your healthcare provider. Always seek the guidance of a qualified healthcare professional before making any changes to your treatment plan or if you have any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or observed in the App.
No Emergency Use: Subseven is not an emergency alert system. It does not provide real-time monitoring for urgent medical conditions or active glucose alerts, and it is not intended to be relied upon in urgent or life-threatening situations. If you suspect you have a medical emergency or a serious health issue, call emergency medical services immediately (e.g., dial 911 in the United States) . Do not wait for data or insights from Subseven in an emergency. We are not responsible if you choose to rely on the App during an acute event rather than seeking immediate medical attention.
Accuracy of Data: We strive to make the analytics and pattern recognition as accurate and useful as possible, but we do not guarantee the accuracy or completeness of any information or insight provided by the App. Health data can be complex and individual responses vary; the App’s suggestions or identified trends might not apply in every situation. The App’s AI-driven insights are based on the data you log and the data we obtain (such as blood glucose readings). If your input data is incomplete or inaccurate, the resulting analysis may be inaccurate or misleading. You should use your own judgment and consult healthcare professionals when interpreting the App’s outputs.
User Responsibility: You are responsible for managing your diabetes in consultation with medical professionals. Subseven is a supportive tool. Any decisions you make regarding insulin dosing, diet, exercise, or other aspects of your treatment based on App insights are your decisions. We strongly advise that significant changes in your management (for example, adjusting basal insulin rates or medication doses) be done in consultation with a doctor. You agree that you understand the limitations of the App and will not hold Subseven liable for any outcomes that occur from your use of the App’s information (see Limitation of Liability below).
Privacy and Data Use
Your privacy is very important to us. By using the App, you consent to the collection and use of your data as outlined in our Privacy Policy (see below for the full Privacy Policy). In summary, Subseven collects personal information such as your name and email during account registration, and health-related information that you log (e.g., event records like meals or workouts) or that you permit the App to access (e.g., blood glucose data from Apple HealthKit). This data is used to provide you with analytics, charts, and insights into your blood glucose management, and to improve our services. We do not share your personally identifiable data with third parties for marketing or advertising purposes . In fact, Apple’s HealthKit guidelines explicitly prohibit developers from using health data for any purpose other than providing health or fitness services to you , and we strictly adhere to these rules.
Any health data we obtain through Apple’s HealthKit (such as your Dexcom CGM readings) is used within the App for your benefit – for example, correlating glucose trends with logged events – and, with your permission, may be used in an anonymized or de-identified form to contribute to broader research and analytical insights (see Privacy Policy for details). We will never sell your personal health information or use it to show you third-party advertisements . By agreeing to these Terms, you give Subseven permission to access and process your health data as described. You can revoke the App’s access to HealthKit data at any time via your iPhone’s Health app settings (note that doing so may limit App functionality).

Intellectual Property Rights
Subseven’s Content: The Subseven App (including all software code, algorithms, design elements, text, graphics, logos, images, and other content in the App) is the intellectual property of Subseven (or its licensors) and is protected by copyright, trademark, and other intellectual property laws. Subseven and the Subseven logo are trademarks/service marks of our company. You are granted a limited, revocable, non-exclusive, non-transferable license to use the App and its content for your personal use only, in accordance with these Terms. This license does not grant you any ownership of the App or related intellectual property.
You agree not to copy, distribute, modify, publish, or create derivative works from any part of the App. You may not remove or alter any copyright, trademark, or other proprietary rights notices from the App. All rights not expressly granted to you in these Terms are reserved by Subseven.
User-Provided Data: As part of using the App, you will input or allow us to access certain data (e.g., health and wellness information, blood glucose readings). We do not claim ownership of the raw data you provide about yourself. You retain ownership of your personal information and data. By using the App and providing data, you grant Subseven a license to use that data solely for the purposes of providing the service to you, analyzing and deriving insights, and for our internal research and improvement of the App (in accordance with the Privacy Policy). We will not use or share your data outside of these purposes without your consent. Any aggregated or anonymized information (which can no longer identify you personally) that is derived from user data is owned by Subseven – for example, statistics about how many users tend to have high blood sugar after a certain type of meal might be aggregated and used by us – but such aggregated data will not identify any individual user.
Third-Party Services and Links
Apple HealthKit and Other Integrations: Subseven integrates with Apple’s HealthKit framework to read certain health data (like blood glucose values) that you authorize from your device’s Health app. This integration is subject to Apple’s own terms and privacy policies. Please be aware that Apple’s App Store Review Guidelines impose strict privacy requirements on HealthKit data (for instance, “Apps using the HealthKit framework that store users’ health information in iCloud will be rejected” , and apps cannot use HealthKit data for purposes unrelated to improving health). We do not upload your health data to Apple’s iCloud servers . Instead, if we store your HealthKit-derived data, we store it on our secure servers (or rely on the data staying on your device) in compliance with Apple policies and applicable laws. By using Subseven, you acknowledge and consent to this use of HealthKit and other third-party frameworks as part of the service.
Aside from HealthKit, if the App in the future links to or integrates with any other third-party services or content (such as a link to an educational article or a feature to export data to a third-party app), those services may have their own terms and privacy policies. Subseven is not responsible for third-party content or services that are not under our control. We encourage you to review the terms of any third-party services you access.
No Clinical or Professional Services Guarantee: While Subseven’s goal is to assist you and potentially your clinician in understanding your diabetes patterns, using Subseven does not establish any patient-doctor relationship or any other professional relationship between you and Subseven. We are not a healthcare provider. Any data or reports from the App that you choose to share with your healthcare provider are your responsibility. Subseven makes no guarantee that clinicians will accept or use the data from the App, and we are not liable for the interpretations made by any third parties (including healthcare providers) who see your data.
Termination of Use
By User: You may stop using the App and terminate your account at any time. If you wish to delete your account and all personal data, you can contact us at our support email (provided in the Contact section) with your request. Keep in mind that simply deleting the App from your device does not automatically cancel your subscription or delete your account data. You must also cancel the subscription through Apple if you wish to stop recurring charges (see Subscription section above). Upon account deletion, we will remove or de-identify your personal information in accordance with our Privacy Policy (subject to any data retention obligations).
By Subseven: We reserve the right to suspend or terminate your access to the App at our discretion if we believe you have violated these Terms or are misusing the service. We may also terminate the service or user accounts for inactivity over an extended period, non-payment of the subscription fee, or if required by law to discontinue service. In most cases of non-violation (e.g., if we decide to shut down the App or discontinue the service entirely), we will give advance notice to users via the App or email.
If we terminate your account due to a breach of these Terms or unlawful behavior, we are not obligated to refund any prepaid fees. In cases of termination, your right to use the App will cease immediately, and you should delete any copies of the App from your devices. Sections of these Terms that by their nature should survive termination (such as disclaimers of warranties, limitations of liability, and indemnity) will continue to apply even after your use of the App ends.
Disclaimers of Warranty
Subseven is committed to providing a high-quality service, but the App and all of its services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Subseven disclaims all warranties, express or implied, regarding the App and its content. This includes but is not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of data, or reliability of results. We do not guarantee that the App will meet your expectations or achieve any specific health outcomes for you.
No Guarantee of Correctness or Accuracy: We make reasonable efforts to ensure the information presented (such as trend analysis or pattern insights) is accurate based on the data provided, but we make no warranty that any numerical values, charts, suggestions or conclusions are 100% accurate or error-free. Health data analysis is complex, and there may be errors, bugs, or inaccuracies in how data is processed. You acknowledge that any reliance on the App’s information is at your own risk.
Availability: We do not warrant that the App will be available at all times, or that it will be provided uninterrupted or error-free. Downtime may occur for maintenance, updates, or due to technical issues. We will strive to inform users in advance of planned maintenance downtime, but we are not liable for any unavailability or data loss that might occur. We cannot guarantee that the App will be compatible with every device or that it will be free from viruses or other harmful components (though we take measures to prevent such issues).
Not a Medical Device: The App is not subject to FDA approval as a medical device (it is not intended to deliver insulin or make active treatment decisions on your behalf). The App’s classifications, insights, or notifications should not be solely relied upon to make medical decisions. It is a supportive tool that does not come with any warranty or guarantee of medical accuracy or safety. You should always cross-check critical information with other sources or professionals.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such jurisdictions, warranties are disclaimed to the maximum extent permitted by law.
Limitation of Liability
Use at Your Own Risk: To the maximum extent permitted by applicable law, in no event will Subseven or its founders, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any damages for personal injury, medical complications, wrongful death, lost profits, loss of data, business interruption, or other losses, arising out of or in connection with your access to or use of (or inability to use) the App, even if we have been advised of the possibility of such damages. This limitation applies to all causes of action, whether based on warranty, contract, tort (including negligence), or any other legal theory.
Limitation of Direct Damages: Insofar as any liability is not legally excludable, you agree that our total liability to you for any claims arising from your use of the App or these Terms will not exceed the amount that you paid to Subseven in subscription fees in the 3 months immediately preceding the event giving rise to the claim. If you have not paid any subscription fees (for example, if a free trial was available and you did not continue), our liability would be limited to the lowest amount the law allows. This limitation is cumulative and not per-incident.
User Data and Health Outcomes: You acknowledge that managing diabetes carries inherent risks, and that while using our App might aid in understanding patterns, it is ultimately your responsibility to manage your condition with professional guidance. Subseven is not liable for any health event (such as hyperglycemia, hypoglycemia, or any complications) that might occur – even if you believe the App failed to predict it or contributed to it. Always follow medical advice and use the App as a supplementary tool.
Because some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, the above limitations may not apply to you in full. In such cases, liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Subseven and its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the App, (b) your violation of these Terms, (c) your violation of any applicable law or regulation in connection with your use of the App, or (d) any content or data you input into the App (for example, if you input false data and that leads to some dispute or issue). We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that case, you agree to cooperate with our defense of such claim and you will not settle any such matter without our prior written consent.
Governing Law and Dispute Resolution
These Terms of Use and any dispute arising out of or related to the App or these Terms shall be governed by and construed in accordance with the laws of the United States and the laws of the State of Pennsylvania, without regard to its conflict of law principles. By using the App, you agree that any disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction and venue in those courts. If you reside outside of the United States, you agree that you are voluntarily subjecting yourself to the jurisdiction of the courts in the United States for such disputes, and that you will not claim lack of jurisdiction or inconvenient forum.
International Use: We make no representation that the App or these Terms comply with the laws of any country outside the United States. If you access the App from outside the U.S., you do so on your own initiative and are responsible for compliance with local laws if and to the extent they apply.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable (if possible) or deemed severed, and the remaining provisions of these Terms shall remain in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Subseven.
Changes to the Terms
Subseven may revise or update these Terms of Use from time to time. If we make material changes, we will make reasonable efforts to notify you – for example, by posting the updated Terms within the App and updating the “last updated” date, or by sending a notice to the email associated with your account. It is your responsibility to review these Terms periodically for any changes. Your continued use of the App after any modifications to the Terms indicates your acceptance of the updated Terms . If you do not agree to the revised Terms, you must stop using the App and cancel your subscription.
